Class 2 Producer

Reference Clauses of the Act : Art. 5, para. (2) and Art. 10-2

It means a person other than a Class 1 Producer who produces high pressure gas and falls under any of the following items:

(1) a person conducting the business of producing high pressure gas (except for persons producing high pressure gas for the purpose of refrigeration (including heating by means of refrigeration equipment; hereinafter the same applies in item (2))) (including the case where certified Specified Equipment as referred to in item (3) is used in combination);

(2) a person producing high pressure gas using equipment with a refrigerating capacity of not less than 3 tons (or 5 tons when fluorocarbon (except for inert fluorocarbon) or ammonia is used as a refrigerant or 20 tons when carbon dioxide and fluorocarbon (limited to inert fluorocarbon) is used as refrigerant) per diem by compressing or liquefying gas for the purpose of refrigeration (including the case where certified Specified Equipment as referred to in item (3) is used in combination); and

(3) a person producing high pressure gas using certified Specified Equipment.

In that case, a “person conducting the business of production” as referred to in item (1) means a person who carries out production continuously and repeatedly. Such a person whose business is to transfer high pressure gas from full containers to empty containers by so-called “pouring filling” and a person whose business is to produce high pressure gas using equipment with a capacity for processing less than 100 m3 (or 300 m3 in the case of Class 1 Gas) of gas fall into the category of Class 2 Producer.
Moreover, the term “Class 2 Producer” is defined in Article 10-2 of the Act.

In addition, persons producing high pressure gas only once (not on a regular basis) using equipment with a capacity for processing less than 100 m3 (or 300 m3 in the case of Class 1 Gas) of gas are regulated pursuant to Article 13 of the Act as “Other Production.”
